Terms and Conditions

1. Introduction

These Terms and Conditions (โ€œTermsโ€) apply to the Dicta mobile application (โ€œApplicationโ€), provided under the Dicta brand (โ€œService Providerโ€) and offered as a free-to-download application with optional paid features and subscriptions.

By downloading, accessing, purchasing a subscription to, or otherwise using the Application, you agree to these Terms. If you do not agree with these Terms, you should not use the Application.

Unauthorized copying, modification, distribution, reverse engineering, decompilation, translation, or creation of derivative works based on the Application or its content is prohibited except where such restrictions are not permitted by applicable law.

All intellectual property rights relating to the Application, including its software, design, branding, trademarks, copyrights, and other proprietary materials, remain the property of the Service Provider or its licensors.

The Service Provider may modify, improve, add, or remove features from the Application from time to time. Certain features may require a paid subscription or other purchase.


2. Use of the Application

Dicta allows users to record audio, generate transcriptions, and use AI-powered features such as summaries, outlines, and question-and-answer functionality.

You are responsible for:

  • Using the Application in compliance with applicable laws
  • Maintaining the security of your device and account
  • Ensuring that you have the necessary rights and permissions to record, upload, transcribe, or process any audio or other content
  • Obtaining consent from other individuals where required by applicable recording, privacy, or data-protection laws

You must not use Dicta to record or process conversations where doing so would violate applicable law or the rights of another person.

Some features require an active internet connection. The Service Provider is not responsible for reduced functionality or inability to access online features resulting from connectivity issues, network outages, carrier restrictions, or other circumstances outside its control.

Your mobile carrier may charge you for mobile data, roaming, or other connectivity costs associated with using the Application. You are responsible for such charges.

You must not attempt to interfere with the Application, gain unauthorised access to its systems, circumvent usage restrictions, misuse its infrastructure, or use the Application for unlawful, abusive, fraudulent, or malicious purposes.


3. Recordings and User Content

You retain ownership of recordings, transcripts, and other content you create or upload through Dicta (โ€œUser Contentโ€).

You grant the Service Provider a limited right to process your User Content solely as necessary to:

  • Provide transcription and AI-powered features
  • Store and retrieve content made available through your account
  • Operate, maintain, secure, and improve the Application
  • Comply with applicable legal obligations

You represent that you have all necessary rights, permissions, and consents required to submit and process your User Content through Dicta.

The Service Provider does not claim ownership of your User Content.


4. AI-Generated Content

Certain Dicta features use artificial intelligence to generate transcripts, summaries, outlines, answers, and other outputs.

AI-generated content may contain inaccuracies, omissions, misunderstandings, or other errors. You are responsible for reviewing and verifying AI-generated content before relying on or using it.

Dicta should not be relied upon as a substitute for professional legal, medical, financial, or other professional advice.

The Service Provider does not guarantee the accuracy, completeness, reliability, or suitability of AI-generated outputs.


5. Third-Party Services

Dicta relies on third-party service providers to operate certain features of the Application.

These may include:

  • Google Cloud โ€“ cloud infrastructure, backend services, and storage
  • Deepgram โ€“ speech-to-text transcription
  • OpenAI โ€“ AI-powered summaries, outlines, Q&A, and related features
  • Mixpanel โ€“ product analytics and usage insights
  • Adapty โ€“ subscription and in-app purchase management

These third-party providers may process information as necessary to provide their respective services.

Your use of certain features may also be subject to the applicable terms and privacy policies of these third-party providers.

The Service Provider is not responsible for outages, changes, errors, or other issues caused by third-party services that are outside its reasonable control.


6. Subscriptions and Purchases

Dicta may offer subscriptions or other in-app purchases that provide access to premium features.

Payments are processed through the platform from which you purchased the subscription, such as the Apple App Store or Google Play Store.

Subscription pricing, billing periods, trial availability, and included features will be displayed before you complete a purchase.

Unless otherwise stated by the relevant app store:

  • Subscriptions automatically renew unless cancelled before the end of the current billing period
  • Your account may be charged for renewal in accordance with the terms shown at the time of purchase
  • You can manage or cancel your subscription through your Apple App Store or Google Play account settings

Deleting the Application does not automatically cancel an active subscription.

Refunds are handled according to the policies of the platform through which the purchase was made. The Service Provider generally does not directly control App Store or Google Play billing or refund decisions.

The Service Provider may change subscription prices or included features where permitted by applicable law and platform rules. Any changes affecting an existing subscription will be communicated or applied in accordance with the relevant app store requirements.


7. Free Trials

Certain subscriptions may include a free trial.

The length and availability of a trial will be shown before you begin the subscription.

Unless cancelled before the end of the free trial period, your subscription may automatically convert into a paid subscription and your applicable App Store or Google Play account will be charged.

You are responsible for cancelling the subscription through the relevant platform before the trial ends if you do not wish to continue with the paid subscription.


8. Availability, Updates, and Modifications

The Service Provider aims to keep Dicta available, secure, and functional but does not guarantee uninterrupted or error-free operation.

The Application may occasionally be unavailable because of:

  • Maintenance
  • Technical issues
  • Third-party service interruptions
  • Network failures
  • Security incidents
  • Updates or infrastructure changes
  • Circumstances outside the Service Providerโ€™s reasonable control

The Service Provider may release updates to improve functionality, security, compatibility, or performance.

Certain updates may be required for continued use of the Application.

The Service Provider does not guarantee that Dicta will remain compatible with every device, operating system version, or hardware configuration indefinitely.


9. Suspension and Termination

The Service Provider may suspend or terminate access to Dicta if a user:

  • Violates these Terms
  • Uses the Application unlawfully
  • Attempts to abuse, disrupt, or compromise the service
  • Engages in fraudulent activity
  • Creates security or operational risks for the Application or other users

The Service Provider may also discontinue the Application or individual features where reasonably necessary.

You may stop using Dicta at any time and may delete your account where account deletion functionality is provided.

Termination of your Dicta account does not automatically cancel subscriptions billed through the Apple App Store or Google Play Store. These subscriptions must be cancelled separately through the relevant platform.


10. Limitation of Liability

The Application is provided on an โ€œas isโ€ and โ€œas availableโ€ basis to the maximum extent permitted by applicable law.

The Service Provider does not guarantee that:

  • Transcriptions will always be accurate
  • AI-generated outputs will always be correct or complete
  • The Application will always be available without interruption
  • The Application will meet every user’s specific requirements
  • All errors or technical issues will be corrected immediately

To the maximum extent permitted by applicable law, the Service Provider will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of or inability to use Dicta.

This may include loss of data, loss of revenue, loss of business opportunities, or reliance on inaccurate transcription or AI-generated content.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.


11. Privacy

Your use of Dicta is also subject to our Privacy Policy, which explains how we collect, process, store, and share personal information.

The current Privacy Policy is available through usedicta.app.


12. Changes to These Terms

We may update these Terms from time to time to reflect changes to Dicta, applicable laws, third-party services, or our business practices.

When these Terms are updated, we will revise the effective date shown at the top of this page.

Where required or appropriate, material changes may also be communicated through the Application, our website, or e-mail.

Your continued use of Dicta after updated Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
